John Travolta has asked a judge in the Bahamas to drop the charges against Tarino Lightbourne and Pleasant Bridgewater.
They were charged with trying to get millions out of Travolta in return for keeping an ambulance waiver secret on the day that his son, Jett, died.
The first trial had resulted in a mistrial and Travolta has now decided that he does not want to revisit the tragedy.
He said "The first trial in this matter resulted in a heavy emotional toll on my family."
Earlier this year the Travolta's announced that Kelly is pregnant with a little boy.
Travolta continued "It was finally time to put this matter behind us ... I concluded that it was in my family's best interest for me not to voluntarily return to the Bahamas to testify a second time at trial."
While prosecutors could still file a case it is unlikely, without the victim.
