A Mauritian court has ordered that the police complaints bureau investigate whether one of four men accused in Michaela Harte’s murder, Avinash Treebhoowoon, was tortured into confessing his involvement.
Treebhoowoon is one of the two room attendant who have been charged with murder in the tragic case. They are charged with murdering Michaela Harte, a 27-year-old Irish teacher from County Tyrone, in her honeymoon suite. She had been married just 12 days.
On Wednesday, in court, Magistrate Bonomally made the ruling following Treebhoowoon’s second claim that he had been tortured and beaten by the police.
Last week the police claimed that he had confessed to his part in the murder on January 11th at the Legends Hotel complex. When Treebhoowoon appeared in court he said that he had been forced to confess.
Bonomally ordered a police doctor to examine him. However the doctor then claimed that he could not find any injuries consistent with his claims.
The police insist that Treebhoowoon voluntarily confessed that he and the co-accused Sandip Mooneea killed Michaela when she stumbled upon them trying to steal from her room.
Treebhoowoon’s lawyer, Ravi Rutna, once again, on Wednesday, presented a motion claiming police brutality and asked that his client be allowed to make a statement.
The accused said that after the January 11 hearing he was taken to the Major Crime Investigation Team (MCIT) offices where he was subject to brutality for the second time.
He said “I was undressed and laid on a table. There was a bucket full of water next to the table. Continuously, my head was plunged into the bucket…At the same time, I was beaten up, thus forcing me to confess."
The police are continuing to investigate the murder of Michaela. There are now suspicions that her murderers were members of a crime ring that was operating out of the hotel.
The four men now charged with the murder will remain in custody until February 8th when they can apply for bail.
